Old swimming pool site - further information

Following a number of enquiries from the public, we have investigated the history of this site behind the current council offices at Bourne Hill.

We can confirm that:

  • There is no legal requirement that the site should only be used for any particular purpose, such as leisure, parks or community facilities.
  • It is up to Salisbury District Council to decide whether the site can be used for a different purpose (that is, whether it can change from its current purpose).
  • We have to give public notice and consider any objections before deciding to use the site for any alternative purpose or to dispose of it.
  • If we dispose of the site, it will be at the best value that can reasonably be obtained. Whilst The Local Government Act 1972: General Disposal Consent 2003 says that we can also consider options offering less than "best value", providing we think that the new use of the site would improve the economy, environment, or social well-being of the area, we have decided in principle that securing the asset value of the site is the Council's minimum requirement for the site.

The original deed is handwritten and we are unable to make it available electronically in a readable format, but you can download a Adobe PDFTranscript of the Swimming Pool Covenant 14kb from this website.

You can also download a letter from the Adobe PDFDepartment for Environment, Transport and the Regions regarding Powers of Appropriation 49kb, dated 21 September 1999. This sets out the council’s powers of appropriation (rights to use and sell) the site.
