Part 2 Article 7 - The Executive

To be read in conjunction with Part 4 of the Constitution.

The role of Executive

Leader with Cabinet

7.01 Role

The executive will carry out all of the local authority's functions which are not the responsibility of any other part of the local authority, whether by law or under this Constitution.

7.02 Form and Composition

The executive will consist of the executive leader together with at least 2, but not more than 9, councillors appointed to the executive by the Council. The leader will decide which of those elected shall perform spokesperson roles.

7.03 Leader and Deputy Leader

The leader and deputy leader will be councillors elected to these positions by the Council. The leader and deputy leader will hold office until:

  1. he/she resigns from the office; or
  2. he/she is suspended from being a councillor under Part III of the Local Government Act 2000 (although he/she may resume office at the end of the period of suspension); or
  3. he/she is no longer a councillor; or
  4. he/she is removed from office by resolution of the Council on the following basis:

    the leader and deputy leader shall be elected annually by simple majority vote at the Annual Council meeting. A vote to remove the leader and deputy leader at any other Council meeting during the year shall require the appropriate motion to be included on the agenda and a two thirds majority of those present and voting at the Full Council meeting; or

  5. there is a change in administration - in which case a fresh election by simple majority vote will be required at a full council meeting which must be held within 4 weeks of the change

7.04 Other Executive Members

Other executive members shall hold office until:

  1. they resign from office; or
  2. they are suspended from being councillors under Part III of the Local Government Act 2000 (although they may resume office at the end of the period of suspension); or
  3. they are no longer councillors; or
  4. he/she are removed from office, either individually or collectively, by resolution of the Council, on the following basis:

    the executive members shall be elected annually by simple majority vote at the Annual Council meeting. A vote to remove an executive member at any other Council meeting during the year shall require the appropriate motion to be included on the agenda and a two thirds majority of those present and voting at the Full Council meeting.

  5. there is a change in administration - in which case a fresh election by simple majority vote will be required at a full council meeting which must be held within 4 weeks of the change.

7.05 Proceedings of the Executive

Proceedings of the executive shall take place in accordance with the Executive Procedure Rules set out in Part 4 of this Constitution.

7.06 Responsibility for Functions

The leader will maintain a list in Part 3 of this Constitution setting out which individual members of the executive, committees of the executive, officers or joint arrangements are responsible for the exercise of particular executive functions. (currently individual members will only have a spokesperson roles, but the Council may allow Portfolio members certain executive powers in due course).
