A Local Authority Search should be carried out when a property or piece of land is purchased, leased or valued in order to establish what, if any, matters are affecting the land.
The information given on the search relates only to the property or land that is identified on the search requisition form (LLC1) and submitted with a marked plan showing good location and curtilage. No information is provided on adjoining property or land unless it is specifically requested, which will incur an additional cost.
The search consists of three forms.
N.B. The Local Land Charges Office is unable to answer enquiries on land
ownership. Enquirers should contact the Property Team on (01722) 434435 if it is suspected that the land is council owned. Contact the HM Land Registry (01305) 363670 for all other instances.
Official Search Forms:
All forms are obtainable from Her Majesty's Stationery Office or from any Law Stationers.
For a requisition-only search, only form LLC1 and a marked plan is submitted with a cheque. This type of search will only reveal entries in the Local Authority Search Registers and Planning information.
Parcels of land means land (including a building or part of a building) which is separately occupied or separately rated or, if not occupied or rated, in separate ownership. Remember to include these in the fee submitted.
A personal search is an inspection of the Local Land Charges Registers. It can be carried out by anyone upon payment of the fee.
Please note that a personal search does not provide all the information given on a full search (basic search) and may not be acceptable to some mortgage companies.
It is the responsibility of the person carrying out the search to identify the land or property and to make their own notes of the information on the Registers held in Local Land Charges and Planning Department. No written information is provided by the council.
To arrange a personal search it is advisable to telephone the Local Land Charges office to arrange a time when it is convenient for a qualified member of staff to be available to assist. You will be requested to supply a plan showing the property or land clearly marking the area to be searched. Payment is made after the search is done in the Land Charges Department.
A personal search can be carried out during normal office hours and if possible, avoiding lunch hours (12noon-2pm).
