Commenting on licence applications

If you would like to look at a licensing application in your area, you can view the document at the council's offices at Pennyfarthing House.

Making a representation on an application.

To make a representation (a formal comment that will be considered by the licensing committee) you must live or have an interest in a business within the vicinity of the premises. The Licensing Authority's policy has interpreted 'vicinity' as being within 500 metres in sparsely populated rural areas and 100 metres elsewhere.

Please make sure you state clearly how you believe the application will affect the promotion of one or more of the licensing objectives.

These are:

  • Prevention of crime and disorder
  • Public safety
  • Prevention of public nuisance
  • Protection of children from harm

Please give the full address of the premises for which the application has been made and say how your comments relate to that premises only. We cannot accept comments about other premises or about the effect of the legislation in general.

You must also give your name and your postal address.

Representations must be received within 28 days of the application. The advertisement displayed on the premises and in a local newspaper will show the date by which you can make a representation. If representations are not withdrawn the licensing committee will hold a hearing within approximately one month to decide whether to approve, condition or refuse the application. If you make a representation you will be informed of the time and date of the hearing and how it will be conducted.

Frivolous or vexatious representations cannot be accepted.

Salisbury District Licensing Authority is bound by the provisions set out in the Licensing Act 2003 and associated Regulations and has little discretion regarding processing applications.
