Pollution Prevention and Control

The Pollution Prevention & Control Act 1999 and associated regulations give local authorities powers to control emissions to atmosphere from a large number of industrial installations. These installations require prior approval before operating.

These controls affect around 21,000 industrial plants in England and Wales. In Salisbury there are approximately 50 such installations. The main features of this system of control are:

  • Operators of large installations (classed as A1 in the regulations) will generally be controlled by the Environment Agency.
  • Small and medium sized processes (known as A2 + B processes) are designated for control by local authorities.
  • Prescribed processes must not be operated without a valid permit (or authorisation under the old regime).
  • Operators of these installations must submit a detailed application to the authority
  • Local authorities will include conditions in an permit to ensure the operations comply with best available technique (BAT)

Process guidance notes have been issued by the Secretary of State detailing their view on what generally constitutes BAT for any specific process type. You can find these at www.defra.gov.uk

Local authorities can issue enforcement, variation, prohibition or revocation notices.

This system is designed to achieve four main objectives:

  • to reduce industrial emissions and improve air quality
  • to provide clarity, certainty and a level playing field for business
  • to provide public access to information
  • to provide a clear basis for enforcement

This legislation replaces authorisations issued under the Environmental Protection Act 1990 and for existing processes is being phased in on a rolling timetable.

Legislation affecting companies using solvents is also being introduced and incorporated into the PPC regime.

Public Register

A requirement of the Pollution Prevention & Control Act 1999 is that local authorities compile and maintain a public register containing details of authorised processes within their district.
